Southern Sudan is exempted from Sudan sanctions by the Office of Foreign Assets Control (OFAC) since October 13th, 2006 with exception of Petroleum or Petrochemical Industries - Executive Order 13067 November 4, 1997 imposed sanctions on Sudan, but Executive Order 13412 October 13, 2006 exempted Southern Sudan, Southern Kordofan/Nuba Mountains, Blue Nile States, Abyei, Darfur and areas in and around Khartoum.
- A Non-governmental Organization (NGO) is not subject to Sudan sanctions and can operate in the whole of Sudan for humanitarian purposes and can obtain a license from OFAC expeditiously. For Trans-shipment of technology equipment such as computer which has dual use, contact US Department of Commerce for a license and explain thoroughly the nature of business of your organization.
- The only sanction on Southern Sudan is one that prohibits US Companies involvement in Petrochemical Industries, however, all other industries are open for large US and foreign companies , small and medium companies and investors.
- Trans-shipment of goods and services from the United States and other countries into Southern Sudan and marginalized areas is via Port Mombasa in Kenya.
- Wire transfer of funds from the United and other countries into Southern Sudan is via East African banks in Kenya such as Kenya Commercial Bank which has branches in Southern Sudan; logistically this is easier and cost-effective.
